Fall in manhole disowned by the city
Last Christmas, a 78-year-old man fell into a manhole in Ahuntsic‑Cartierville because the cover had been displaced by snow machinery. He wants a relatively modest $5000 from the city, but they say he wasn’t using a proper crossing so it’s not their fault – although it’s a quiet residential street, not a busy boulevard.

OMG fuck the borough, just give the man his meny and secure your borough’s sites. If anythign it should be passed on to the snow removal firm as they should not have popped the cover without replacing it.

Ian, that certainly looks like a borough truck, and it appears it’s generally the borough, not a contractor, that plows the streets in Ahuntsic. Also the fact that this problem had happened multiple times, and it’s still not fixed, shows the borough is negligent.
As for them walking in the quiet street, notice that they venture into the street at a driveway of a neighbour where the neighbour, or likely their contractor, illegally pushed snow from their driveway onto the street and sidewalk, partially blocking it. It’s possible they paid for a permit to do this, but they’d need to show they don’t have space on the property to store it, and they seem to have a big lawn, so they’d likely be ineligible.

I imagine that the borough will pay up quickly now that La Facture is involved; otherwise I suspect the borough lawyer will advise a settlement once the demand letter is received. Though I am big believe in you can’t fight city hall, it’s pretty say to imagine a small claims court judge quickly deciding in favour of the citizen here.
