Dr. Mark Roper has been making the same arguments about PREM for years:

He took the government to court in 2019, and lost in 2022.
Superior Court Judge Poulin in a very long and detailed decision explained why the department decision could not be reviewed judicially :

In October 2023 the Court of Appeal in a very short decision agreed with Judge Poulin, and refused the appeal.
